ARTICLE 1 – SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE
These General Terms and Conditions of Sale (“GTCS”) define the rights and obligations of Auricoste, a limited liability company with capital of 80,000 euros, whose registered office is located at 35 rue Fondary, 75015 Paris, France, registered with the Paris Trade and Companies Registry under number 327 544 896 (“Auricoste”), and any individual or legal entity (“Customer”) wishing to make a purchase from the official Auricoste website (“Site”).
By validating an order on the Site, the Customer acknowledges that he/she has read and unreservedly accepts these GCS. Auricoste reserves the right to modify the GCS at any time. The applicable terms and conditions are those in force on the date the order is validated by the Customer.
ARTICLE 2 – ORDERING PROCESS
2.1. Identification and Validation
To place an order, the Customer selects the desired product(s) and provides the following information:
Last name, first name, billing and delivery address, e-mail address, telephone number.
2.2. Payment
The customer pays using one of the secure methods available: credit card via the secure Stripe platform, bank transfer or PayPal. An order confirmation is sent by email containing a summary of the order.
2.3. Order Refusal
Auricoste reserves the right to suspend or cancel any order in the event of suspicion of fraudulent payment, previous dispute with the Customer or non-payment of a previous order.
ARTICLE 3 – PRICES
The prices of products displayed on the Site are expressed in euros and include VAT applicable in France. Delivery charges are mentioned separately when the order is validated. For orders outside the European Union, customs duties or other taxes may apply and are the exclusive responsibility of the Customer.
ARTICLE 4 – DELIVERY
4.1. Lead times and availability
Products are delivered to the address indicated by the Customer within a maximum of 30 days following validation of the order. If a product is unavailable, the Customer will be informed and will have the option of obtaining a refund or choosing a replacement product.
4.2. Delivery charges
Delivery costs are calculated carriage paid on orders over 50 euros inc.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1. Conditions
The customer has a period of 14 calendar days to exercise his right of withdrawal, without having to justify his reasons. This period runs from receipt of the products.
5.2. Return procedure
The Customer must notify Auricoste of his decision to withdraw by e-mail (to the address info@auricoste.fr) or by post sent to : Auricoste, 35 rue Fondary, 75015 Paris, France.
Products must be returned in their original packaging, in perfect condition, accompanied by proof of purchase. Return shipping costs are at the customer’s expense.
5.3. Refund
Auricoste will refund the price of the product within a maximum of 15 days following receipt of the returned products.
ARTICLE 6 – LEGAL WARRANTIES
Auricoste applies the following legal guarantees:
– Legal guarantee of conformity (Articles L.217-4 to L.217-14 of the French Consumer Code): Valid for 2 years from delivery.
– Warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
ARTICLE 7 – LIABILITY
Auricoste cannot be held responsible for any indirect damage resulting from the use of its products. The products comply with current French legislation. It is the Customer’s responsibility to verify the conformity of the products with the legislation of his country of residence.
ARTICLE 8 – PERSONAL DATA
The information collected is processed for order management purposes. In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and delete their personal data.
ARTICLE 9 – SETTLEMENT OF DISPUTES
In the event of a dispute, the parties will endeavor to find an amicable solution. Failing agreement, the dispute will be referred to the competent Paris courts. A mediation procedure is also available via the European platform https://ec.europa.eu/consumers/odr.
